We wrote these Terms in plain language, but they are still a binding agreement, so please read them. These Terms of Service ("Terms") are between you and Haider Nawaz ("we," "us," "our"), the developer of the Simple Health iOS app, its companion Apple Watch app, and its widgets (together, the "App"). By creating an account or using the App you agree to them; if you do not agree, do not use it. Both these Terms and our Privacy Policy are available inside the App and at our legal pages.
Simple Health reads health and fitness data from Apple Health (HealthKit), with your permission, and uses AI to explain it in plain language. It can show summaries and insights on your iPhone, Apple Watch, and home screen widgets, and can send you smart notifications about your activity.
This agreement is between you and Haider Nawaz only, not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the App and its content. Your purchase and download of the App through the App Store is also governed by the Apple Media Services Terms and Conditions, which control your relationship with Apple.
You must be at least 13 years old, and at least the minimum age required in your country to consent to digital services on your own. The App is not directed at children. By using the App, you confirm you meet these age requirements.
You sign in with Sign in with Apple. That is the only sign-in method. When you sign in, we receive a stable Apple identifier for your account, your email address (which may be an Apple private-relay address if you chose Hide My Email), and optionally your name on first sign-in.

You are responsible for activity that happens under your account.
The App only reads Apple Health data that you explicitly grant it permission to read, using the standard iOS Health permissions screen. You can change or revoke those permissions at any time in the iOS Settings or Health app. If you revoke permissions, parts of the App will stop working, but that is your choice to make.
We never use your health data for advertising or marketing, never sell it, and never share it with third parties for their own purposes. Our Privacy Policy describes exactly what we collect, where it goes, and how to delete it.
The App lets you choose how your insights are generated:
If you enable smart notifications, the notification text is generated by the cloud AI, regardless of which AI engine you selected. When a notable event happens (such as a workout, sleep, mindfulness, your activity rings, or a heart event), the App sends a short summary of that single event to our server and on to OpenAI to write the notification text. This applies to every account with notifications enabled, including the free plan. If you do not want this, turn off the App's notifications in iOS Settings. Our Privacy Policy describes this in full.
AI-generated text can be inaccurate, incomplete, biased, or misleading, even when it sounds confident. Insights are based only on the data available to the App, which may itself be incomplete. Do not rely on AI output for medical decisions. When in doubt, check with a professional (see Section 3).
Some features require a paid plan, purchased through Apple In-App Purchase. We offer an On-Device AI tier (monthly, yearly, or a one-time Founding Member lifetime purchase) and a Cloud AI tier (monthly or yearly). In the App Store and your Apple subscription settings these appear under the name "Simple Health Plus." Current prices are always shown in the App before you buy and may vary by country; local taxes may apply.
All payments are processed by Apple, so refunds are handled by Apple, not by us. You can request a refund at reportaproblem.apple.com. We cannot issue refunds for App Store purchases ourselves.
We verify purchases server-side with Apple's App Store Server API to unlock your plan. We never receive your payment card details or billing address; Apple keeps those.
We offer one free trial per account: 24 hours of full access, managed on our servers and tied to your account.
This trial is provided by us, not by Apple, and is separate from any Apple introductory offer.
The Founding Member purchase is a one-time, non-consumable purchase that grants a lifetime license to the On-Device AI tier of the App, including future updates to that tier, for as long as we offer the App. It is tied to your Apple Account, is not transferable, and does not include the Cloud AI tier. "Lifetime" means the lifetime of the App, not your lifetime; see Section 17 about service changes.
We grant you a personal, limited, non-transferable license to use the App on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed by other accounts via Family Sharing or volume purchasing where Apple makes that available.
You may not copy, modify, distribute, sell, rent, reverse-engineer, or attempt to extract the source code of the App, except where the law allows it despite this restriction.

We may suspend or terminate accounts that violate these rules.
The App, including its design, text, graphics, code, and branding, belongs to us or our licensors and is protected by intellectual property laws. These Terms do not give you any ownership of the App. Your health data remains yours; the insights generated for you are for your personal use.
If you send us feedback (for example, by email), you give us permission to use it to improve the App, without any obligation or payment to you.
Our Privacy Policy explains what data we collect, how it is used, which service providers process it (Apple, RevenueCat, Cloudflare, Neon, OpenAI, Mixpanel, and Sentry), and your rights, including deletion. It is part of how we operate but is presented as its own document inside the App and on our website. Where these Terms and the Privacy Policy both speak about data, the Privacy Policy is the more detailed source.
You can delete your account at any time from inside the App ("Delete account"). This permanently deletes everything we store about you: your profile, stored AI insights, push notification tokens, subscription and trial records, and any feedback. We also revoke your Sign in with Apple token using Apple's API, so the App can no longer use it. Short-lived server logs are not deleted individually; they expire on their own schedule (see the Privacy Policy).
We may update, change, or discontinue features of the App, and we may suspend or terminate the service or your access to it, for example if you violate these Terms, if we are required to by law, or if we stop offering the App. Where reasonably possible, we will give notice of significant changes or discontinuation.
If we permanently discontinue the App while you have an active paid period, you may request a refund from Apple at reportaproblem.apple.com (Apple decides refund requests under its own policies), and nothing in this section limits any rights or remedies you have against us under mandatory consumer protection law.
We, not Apple, are solely responsible for maintaining and supporting the App. Apple has no obligation to provide any maintenance or support for it. For support, contact us at haider.builds@icloud.com.
The App is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy of insights, and uninterrupted availability. We do not warrant that the App's output is correct, complete, or suitable for medical use (it is not; see Section 3).
If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App, and any other warranty claims are our responsibility, not Apple's.
Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.

Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, fraud, or your mandatory rights as a consumer.
We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession or use of it, including:
We, not Apple, are also responsible for the investigation, defense, settlement, and discharge of any third-party claim that the App infringes intellectual property rights.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties (such as the Treasury Department's Specially Designated Nationals list or the Commerce Department's denied parties lists). You must comply with all applicable laws when using the App.
You must comply with any applicable third-party terms that apply when using the App, including the Apple Media Services Terms and Conditions and your wireless carrier's data agreement.
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right to enforce them against you as a third-party beneficiary.
These Terms are governed by the laws of Pakistan, without regard to conflict-of-law rules.
Consumer rights carve-out: if you live in a country whose laws give you mandatory consumer protections, those protections still apply to you, and nothing in these Terms takes them away. If you are a consumer resident in the EEA or UK, you also benefit from the mandatory consumer-protection laws of your country of residence and may bring proceedings in your local courts; nothing here deprives you of that. Your purchase relationship with Apple is governed by the Apple Media Services Terms and Conditions, including their dispute provisions.
We may update these Terms from time to time, for example when we add features or when the law requires it. When we make material changes, we will update the effective date at the top and notify you in the App before the changes take effect. If you keep using the App after the changes take effect, the updated Terms apply. If you do not agree with a change, stop using the App and, if you wish, delete your account (Section 16).
If any part of these Terms is found unenforceable, the rest remains in effect. If we do not enforce a provision right away, we are not waiving it. These Terms, together with the Privacy Policy and the Apple Media Services Terms and Conditions where applicable, are the entire agreement between you and us about the App. You may not transfer your rights under these Terms; we may assign these Terms as part of a sale, merger, or reorganization of our business.
